These are rights in rem of enjoyment (such as the right of beneficial use, the right to use and inhabit, easements, censuses, the right of surface area, the rights of overbuilding and underbuilding), guarantee rights (such as mortgage rights or the explicit resolutory condition), of rights preferential acquisition (right of first refusal and right of withdrawal), as well as other rights in rem that the parties decide to create, since creating rights in rem over items is permitted by law, according to the parties’ interests.
